Flera åtgärder har vidtagits på momsområdet för att förhindra bedrägerier och skatteundandragande. Till exempel har omvänd skattskyldighet införts vid omsättning av vissa varor och tjänster, senast vad gäller mobiltelefoner med mera. Regeringen har den 9 juni 2022 gett en särskild utredare i uppdrag att föreslå ytterligare åtgärder för att förhindra bedrägerier och skatteundandraganden på momsområdet.
Momsbedrägerier sker i olika former och med olika konstruktioner. Förutom stora förluster för samhället innebär bedrägerierna att konkurrensen snedvrids till nackdel för företag som gör rätt för sig. Skatteverkets bedömning är att det totala skattefelet för momsen 2019 uppgick till drygt 12 miljarder kronor, det vill säga till cirka 3 procent av den fastställda momsen. Läs mer om skattefelet här. Hur stor del av skattefelet som beror på skattebedrägerier är inte känt. Utredningen ska föreslå åtgärder för att förhindra bedrägerier och skatteundandragande på momsområdet. Utredaren ska särskilt analysera om Skatteverket har tillräckligt effektiva verktyg för att upptäcka och förhindra bedrägerier. VAT Information Exchange System, VIES, är ett elektroniskt system för utbyte av information mellan EU-länder bland annat för kontroll av momsregistreringsnummer. Utredaren ska undersöka om en lämplig åtgärd för att förhindra bedrägerier kan vara att ett företags registreringsnummer för moms visas som ogiltigt i VIES.
Utredaren ska även lämna förslag som innebär att den som är medveten om ett momsbedrägeri och som lämnar uppgifter som i sig är korrekta, men i bedrägligt syfte, ska kunna dömas för skattebrott. Detsamma gäller om oriktiga muntliga uppgifter lämnas.
